HHS has released interim rules on the Early Retiree Reinsurance program. A few significant points you should know are the regulation requires that an employment-based plan implement programs and procedures to generate cost-savings with respect to participants with chronic and high-cost conditions; Medicare eligibility retiree health care costs will not be reimbursed; reimbursement will only be 80% of the totals; applications will be taken on a first come first serve basis; file transfers with the Government will be required.
